Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the Prisma mobile application and related websites, products, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who we are

“Prisma”, “we”, “us”, or “our” refers to the Prisma app and its operating entity. Contact us at support@marketprisma.com.

2. Eligibility and accounts

You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the Services. When you create an account (via Clerk), you must provide accurate information and maintain the security of your credentials. You are responsible for all activities that occur under your account.

3. Subscriptions, billing, and renewals

Prisma may offer free and paid plans. Paid subscriptions are billed through the applicable app store (Apple App Store or Google Play) and renew automatically unless canceled in your store account settings. Prices and features may change; we will notify you of material changes as required by the app store rules.

4. Identification and valuation disclaimers

Any object identification, market comparison, or value estimate provided by Prisma is informational only and not a professional appraisal or a guarantee of sale price. Always perform your own due diligence and consult qualified professionals where appropriate.

5. User content

You retain ownership of content you upload (e.g., photos, notes). You grant Prisma a non‑exclusive license to store and process your content to operate the Services. You represent you have the necessary rights to upload such content and that it does not infringe intellectual property or privacy rights.

6. Acceptable use

You agree not to misuse the Services, including by: (a) uploading unlawful or infringing content; (b) attempting to access accounts or data without authorization; (c) interfering with or disrupting the Services; or (d) using the Services for competitive analysis or to build a competing product in violation of applicable law.

7. Third‑party services

The Services may integrate third‑party services (e.g., marketplaces, payment or subscription platforms, authentication). Your use of third‑party services is governed by those providers’ terms and policies.

8. Privacy

Your use of the Services is also subject to our Privacy Policy. We describe what information we collect, how we use it, and your choices. Where required, we obtain your consent before processing personal data.

9. Termination

You may stop using the Services at any time. You can delete your account and data from the in‑app account settings or by contacting support. We may suspend or terminate access if you violate these Terms or use the Services in a way that creates risk for Prisma or others.

10. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, Prisma disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error‑free.

11. Limitation of liability

To the maximum extent permitted by law, Prisma will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of the Services. Our aggregate liability under these Terms will not exceed the amounts you have paid to Prisma for the Services in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Prisma and its affiliates, officers, employees, and agents from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.

13. Changes to the Services and these Terms

We may update the Services and these Terms from time to time. If we make material changes, we will provide notice as required by law or the applicable app store rules. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict‑of‑laws principles. Venue for any disputes will be the state or federal courts located in Delaware, unless applicable law requires otherwise.
